A presidential proclamation dated September 18 extends the $100,000 payment on certain new H-1B workers outside the US to September 21, 2027. Renewals and workers already in the US are excluded. The administration said H-1B registrations by the largest IT outsourcing firms had fallen 92% since the 2025 proclamation. A Massachusetts federal judge ruled the fee unlawful in June, and the First Circuit refused to stay that ruling on July 24. A US Chamber of Commerce challenge is pending in the DC Circuit.
Why it matters for listed companies
Indian IT services companies have historically used H-1B visas to staff US client sites. The fee raises the cost of sending new staff onshore, which pressures margins on onsite-heavy contracts and pushes delivery toward offshore centres and local US hires. Since collection is blocked by the court ruling for now, the immediate cash impact is limited. The 92% drop in registrations shows large firms have already cut their reliance on new visas.

The finance angle is the contracted revenue: about $36 billion over the initial terms of the leases, paid by the AI cloud companies and hyperscalers that rent the capacity. That backlog is many times current revenue…
The finance angle is where AI work gets paid for. A model that runs on the laptop shifts spending from cloud usage to the device: Nvidia earns from the chip, Microsoft from the hardware and Windows, and the buyer pays…
