Final adjudication orders in the long-running GST cases against gaming companies have come in far below the original notices. Delta Corp's demand was reduced from about Rs 16,000 crore to Rs 117 crore, and Pacific Gaming's from Rs 721 crore to Rs 100.8 crore. No personal penalties were placed on directors. Orders for Dream11 and Gameskraft are due by October 14.
Why it matters for listed companies
The original notices were larger than the companies' own net worth, so the contingent liability hung over the listed casino and gaming operator Delta Corp and over unlisted platforms that had planned to raise capital. The reduced orders shrink that liability to a sum that can be provided for. The 28% GST on the full face value of bets, in force since October 1, 2023, is unchanged, so the tax cost of running the business stays the same.
